Terms of Use

1. Introduction
Welcome to MoveMax. These Terms of Use (“Terms”) govern your access to and use of the website located at movemaxco.com (the “Site”), our online quote form (provided through SmartMoving), and SMS/MMS messages we send to you. By accessing or using the Site, you agree to be bound by these Terms.
The Site is operated by MoveMax Co., an Illinois limited liability company, authorized by the Illinois Commerce Commission, Transportation Division, under Public Carrier Certificate No. 242989 MC.
These Terms govern your use of this website only.
Moving services are governed by a separate written estimate, service agreement, and bill of lading provided at the time of booking. Nothing on the Site constitutes a binding quote or a contract for moving services until confirmed in writing.
2. Use of the Site
You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to use the Site:
- In any way that violates any applicable federal, state, local, or international law or regulation.
- To transmit any unsolicited or unauthorized advertising or promotional material.
- To impersonate or attempt to impersonate MoveMax, a MoveMax employee, or any other person or entity.
- To attempt to interfere with the proper working of the Site, including by introducing viruses or other harmful code.
3. Quotes and Estimates
Quotes and estimates generated through the Site or in response to a Site inquiry are preliminary and non-binding until confirmed by MoveMax in writing following a survey of your inventory and the specific circumstances of your move. Actual charges depend on the final scope of services, time required, and applicable tariffs.
When you submit information through the quote form, you agree to provide accurate and complete information about yourself and your moving requirements.
4. SMS / MMS Messaging Terms
By providing your mobile phone number and opting in, you expressly consent to receive recurring SMS or MMS messages from MoveMax. These Terms apply to all SMS and MMS communications between you and MoveMax.
a) Program description
MoveMax sends SMS and MMS messages related to your quote request, appointment scheduling, move-day coordination, service updates, customer support, and, where you have opted in, occasional promotional offers.
b) Opting out
You can cancel the SMS service at any time. Just text STOP to the number from which you receive messages. After you send the SMS message STOP, we will send you a confirmation message, and you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will resume sending you messages.
c) Help
If you are experiencing issues with the messaging program, you can reply with the keyword HELP for more assistance, or contact us directly at info@movemaxco.com or (773) 658-0601.
d) Carrier disclaimer
Carriers are not liable for delayed or undelivered messages.
e) Message frequency, rates
Message and data rates may apply for any messages sent to you from us and to us from you. Message frequency varies based on your interactions with us and the status of your move; you may receive several messages per week during the period surrounding your move date and fewer at other times. Contact your wireless carrier for details about your plan.
f) No sharing or selling of opt-in data
MoveMax does not share, sell, or rent your mobile phone number or your SMS opt-in or consent information to any third party for their own marketing or promotional purposes. SMS opt-in data is used only to provide the messaging service and is shared only with our SMS service provider as needed to deliver messages.
g) TCPA compliance
MoveMax complies with the Telephone Consumer Protection Act (TCPA) and applicable regulations regarding SMS communications, including obtaining prior express written consent before sending marketing SMS messages where required.

5. Intellectual Property
The Site and all of its content, including text, graphics, logos, images, and the MoveMax name and trademarks, are owned by MoveMax or its licensors and are protected by United States and international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works from any part of the Site without our prior written permission.
6. Third-Party Services and Links
The Site may include forms or content provided by third parties, including the quote form provided through SmartMoving. We are not responsible for the availability, accuracy, or content of third-party services. Your use of those services is subject to the third party's own terms and privacy policy.
7. Disclaimer of Warranties
The Site is provided on an “as is” and “as available” basis. MoveMax makes no representations or warranties of any kind, express or implied, regarding the operation of the Site or the information, content, or materials included on the Site. MoveMax does not warrant that the Site will be uninterrupted, secure, or error-free.
8. Limitation of Liability
To the maximum extent permitted by applicable law, MoveMax will not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages arising out of or relating to your use of the Site, even if MoveMax has been advised of the possibility of such damages. Nothing in these Terms limits any liability that cannot be excluded under applicable law. Liability for the moving services themselves is governed by the separate written agreement for those services.
9. Changes to These Terms
MoveMax may change, modify, add, or remove portions of these Terms at any time. Any changes will take effect when posted on this page, with the Effective Date updated accordingly. Your continued use of the Site after changes take effect constitutes your acceptance of the revised Terms.
10. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the state and federal courts located in Cook County, Illinois.
